Acceptance, by electronic submission, of this bill of lading by the shipper shall constitute the shipper's agreement of the following: 1. Skymail International, Inc. will provide pick-up and delivery service as requested and arrange for air/surface transportation as required. Such services will be furnished as agent for the shipper. 2. In consideration of the transportation charges for the movement of this shipment, it is agreed that the liability of Skymail International, Inc. shall be limited in any event to the sum of $100.00 per consignment total, unless insurance cover is arranged in writing in advance. 3. No liability whatsoever is assumed for delay in delivery or for consequential damages of any kind, such as loss of income, loss of interest or business opportunity or any loss or damage arising for the inherent nature of the goods. 4. Skymail International, Inc. does not agree to carry, and it is agreed that Skymail International, Inc. accepts no liability for items of unusual intrinsic value such as cash, negotiable securities, jewels, furs, or the like. 5. The shipper warrants to Skymail International, Inc. that the shipment is sufficiently packaged to withstand ordinary handling while in transit as well as conditions incidental to transportation such as sudden change in temperature and pressure during air transportation. All packages must be appropriately marked, securely sealed and properly addressed to insure the safety of the materials enclosed while in transit. 6. Skymail International, Inc. shall not be liable for any loss, damage, mis-delivery, or delay unless proved to have been caused by its own negligence and proved there was no contributory negligence by the consignee, nor shall Skymail International, Inc. be liable for any loss, damage, mis-delivery or non-delivery, or acts of God, public enemies, weather, authority of law, riots, strikes, labor disputes, war, or mechanical or other delay or aircraft used in providing transportation services. 7. The shipper, whether principal or agent, warrants to Skymail International, Inc. that the content of the shipment may be lawfully carried aboard airline aircraft to other federally regulated carriers and is not a prohibited commodity under any applicable statutes and regulationship and is properly packaged or sheathed for the purpose if necessary. The shipper will indemnify and hold harmless Skymail International, Inc. against any loss by the latter as a result of the shipper's violation of this provision. 8. Any claim by the shipper for loss or damage in accordance with paragraph 2 hereof shall be noticed in writing to Skymail International, Inc., 1476 S 3600 W, Suite B, Salt Lake City, UT 84104-6510 not later than 7 days after delivery of the shipment to the consignee. Any action or proceeding brought by the shipper against Skymail International, Inc. concerning this shipment shall be commenced within 180 days after deliver of the shipment to the consignee, unless applicable state laws and regulations provide for a longer time period. 9. Shipper agrees that no time is fixed for the completion of transportation hereunder and that carrier may substitute alternative carrier(s). Shipper hereby accepts all the terms, conditions, rates, provisions contained or referred to in this bill of lading and the tariff(s), classifications, rates, regulations, and conditions or carriage of carrier, and hereby agrees that same shall be binding on shipper, consignee and owner of the goods. Shipper guarantees payment of collect charges and advances. 10. For the purposes of the exemptions from liability provisions set forth herein, the term "carrier" shall be deemed to include the agents, servants, and representatives of the carrier. 11. No agent, employee, or representative of Skymail International, Inc. has authority to modify any provision of the terms and conditions. 12. THE SUBMISSION OF THIS ELECTRONIC DOCUMENT BY SHIPPER CERTIFIES THAT IT WILL BE LIABLE FOR AND AGREES TO PAY, SUBJECT TO PRESCRIBED POSTAL LAWS AND REGULATIONS, ANY POSTAGE REVENUE DEFICIENCIES ASSESSED ON THIS MAILING. SHIPPER FURTHER AGREES TO HOLD SKYMAIL INTERNATIONAL, INC. COMPLETELY HARMLESS IN ANY SUCH POSTAGE REVENUE DEFICIENCIES AND AGREES TO PAY IN FULL ANY SUCH DEFICIENCIES. 13. SHIPPER CERTIFIES THAT ANY BUSINESS REPLY, COURTESY REPLY, OR METERED REPLY LETTER, CARDS, OR ENVELOPES, ENCLOSED IN THE PIECES DESCRIBED ON THIS WAYBILL BEAR THE CORRECT FACING IDENTIFICATION MARK (FIM) AND BARCODE. 14. SHIPPER CERTIFIES THAT THE ADDRESS APPEAR ON THE MAIL PIECES DESCRIBED ON THIS WAYBILL HAVE BEEN UPDATED WITHIN SIX (6) MONTHS OF THE DATE OF THIS MAILING USING A USPS-APPROVED ADDRESS UPDATE TOOL. 15. SHIPPER CERTIFIES THAT THE ZIP CODES APPEARING ON THE MAIL PIECES DESCRIBED ON THIS WAYBILL HAVE BEEN VERIFIED AND CORRECTED WHERE NECESSARY WITHIN 12 MONTHS OF THE DATE OF THIS MAILING USING A USPS-APPROVED METHOD. 16. SHIPPER AGREES TO ALL TERMS AND CONDITIONS ON USPS FORM 8096. 17. SHIPPER CERTIFIES THAT ALL INFORMATION FURNISHING ON THIS WAYBILL IS ACCURATE AND TRUTHFUL, THAT THE MAIL MEETS ALL APPLICABLE CASS/MASS STANDARDS FOR ADDRESS AND BARCODE ACCURACY, AND THAT THE MATERIAL PRESENTED QUALIFIES FOR THE RATES OF POSTAGE CLAIMED. 18. SHIPPER UNDERSTANDS THAT THE SUBMISSION OF FALSE, FICTITIOUS, OR FRAUDULENT STATEMENTS MAY RESULT IN IMPRISONMENT OF UP TO FIVE (5) YEARS AND A FINE OF UP TO $10,000 (18 USC 1001). IN ADDITION, A CIVIL PENALTY OF UP TO $5,000 AND ADDITIONAL ASSESSMENT MAY BE IMPOSED (33 USC 3802). 19. SHIPPER AGREES THAT POSTAGE IS TO BE PREPAID BY THE SHIPPER. 20. SHIPPER AGREES TO AN ADDITIONAL 1.5% PER MONTH INTEREST CHARGE ON ALL ACCOUNTS NOT PAID WITHIN 30 DAYS AFTER DUE DATE, BOTH BEFORE AND AFTER JUDGEMENT, AND CONTINUING EACH MONTH UNTIL PAID. IN THE EVENT OF DEFAULT, THE SHIPPER AGREES TO PAY ALL COSTS OF COLLECTION AND ATTORNEY'S FEES NOT TO BE LESS THAN 18% TOGETHER WITH COSTS OF COURT AND FURTHER AGREES THAT ANY LEGAL ACTION BROUGHT HEREUNDER MAY BE BROUGHT IN SALT LAKE CITY, UTAH.
